WEDDING AND ENGAGEMENT PHOTOGRAPHY - TERMS & CONDITIONS


1. In the following terms and conditions Photography by Noble Limited shall be referred to as “the Photographer” and the Bride and /or Groom in the wedding and engagement booking, hereinafter referred to as “the Client(s)”.


2. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.  


3. Retainer & Booking Fee

A retainer of 40% as well as full acceptance of this terms and conditions secures the time and services of the Photographer(s) for the wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the Photographer due to cancellation. Payment of the retainer/booking fee will be taken as a full acceptance of this terms and conditions and deducted from the overall balance.   


4. Payments

Following payment of the retainer Fee, the remaining balance is due one month prior to the wedding date. No Photographs, albums or any additions will be delivered until all payments due have been paid in full. Payment for additional photo album or other additions is to be made in full at the time of ordering.  

For engagement shoot, the remaining balance is due one week prior to the shoot date.  Payment for additional Attendance Hours, where agreed on the day of the wedding, must be made latest a week following the wedding date. For engagement shoot, this payment must be made latest a day after the shoot and includes no additional images.


5. Prices

All prices are as at the time of making a retainer/booking fee payment, but in the event that changes arise that are outside the Photographer(s) control, for instance but not exclusively, the costs of prints and other additions then the Photographer will inform the Client(s).


6. Wedding and Engagement Arrangements

The details of the wedding and engagement arrangements (time/locations) are to be agreed beforehand in writing. The Client(s) shall notify the Photographer of any changes to these details in writing before the event day. It is the Client’s responsibility to allow sufficient time for each event/coverage to be photographed. The Photographer will not be responsible for the lack of coverage where insufficient time is not allocated; this includes and is not limited to delays in the day due to the ceremony over-running or delays caused by other wedding vendors. The Client(s) also agrees to give the Photographer sufficient notice of key events at the wedding to give the Photographer time to prepare.


7. Cancellation & Rescheduling

The Client(s) may cancel this contract at any time by giving written notice to The Photographer, but in doing so shall forfeit any monies paid. Cancellation less than 12 weeks before the wedding will result in the payment in full becoming due. All cancellations must be in writing.  In the event of cancellation by the client in exceptional circumstances (e.g. bereavement) and at the discretion of the photographer(s) any fees paid may be transferred to a future date within 12 calendar months of the original date booked (subject to availability). The new package price will reflect pricing in effect when the date change occurs.  


8. Harassment

These Terms and Conditions will be in breach if the Photographer(s) experience any threatening, hostile, abusive or offensive words/behaviour from the Client(s) or any guest(s) at the wedding. This may result in the immediate termination of this contract and no refund will be made to the Client(s).


9. Images  

For engagement shoots, images will be electronically delivered two (2) weeks after final selections are made. It is the Client’s responsibility to get their chosen photographs back to the Photographer within a week of receiving proof images from engagement shoot for editing to commence. No unedited images will be given.

For weddings, images will be electronically delivered within 10 weeks after the wedding date. Where two ceremonies are being covered by the Photographer in the same week, images from both ceremonies are electronically delivered no later than 12 weeks after the second ceremony date.

Where applicable, it is the Client’s responsibility to get their chosen photographs back to the Photographer within three (3) weeks for commencement of your wedding product. Album production is 4-6 weeks from the date final selections are made by the client. If your photographs get to us late, it will be placed at the back of the production queue and a new delivery date will be issued.  

All image sizes are nominal. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record digitally the exact colour as seen by the human eye.

For a booking involving a church ceremony or at certain venues, the photographer's movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the ceremony may not be the photographer's choice and the photographer cannot accept responsibility for any obstructed view should this be the case.


10. Creative License

The Photographer(s) shall be granted artistic license in relation to the poses photographed and the locations used. Due to the vagaries of the weather and the willingness of subjects, it may not be possible to capture all the images requested. The Photographer(s) will make their best effort to honour requested photographs but does not undertake any guarantee for any specific picture nor incorporate any specific background, location or group arrangement.  


11. Display

It is agreed that the Photographer may display any photographs included in this contract in his studio, website, social media pages, portfolio, display areas, exhibitions, competitions, advertising or slide shows. For exclusive privacy, the client has the option to purchase the display/controlling rights of images at sum of £1500.


12. Copyright

The copyright Designs and Patents Acts assign the copyright of the images to the photographer. Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Photographer/s in writing.


13. Third Party Printing

The photographer cannot accept any responsibility or liability for colour balance or quality of any Prints reproduced by Third Party Printers such as High Street photo processing shops.  


14. Travel and Subsistence

For wedding venues within England and outside a 50-mile radius from Bedford, travel cost start from £30. Clients agrees to cover car parking charges of the Photographer(s) where applicable. For destination weddings and weddings outside of England, the client agrees to cover the entire travel cost from the photographer’s home to and from the venue in addition to the cost of the service. All flights are to be booked according to the photographer’s date and time preference to allow for enough preparation. Flights should be direct from any London Airport and inclusive of two (2) check-in luggage plus one (1) carry-on bag. Where the wedding ceremony requires an overnight before the wedding or longer stay after the wedding, whether in the UK or abroad, the client agrees to cover the entire cost of a private room(s) within a 3-star hotel and subsistence charges for the Photographer and if applicable, second photographer unless provided by the Client(s).

For bookings of six (6) hours or longer, it is the Client(s)’s option to provide a hot meal for the Photographer(s). If a hot meal is not provided for the Photographer(s), the Photographer(s) may have to leave the venue to purchase a hot meal from the nearest location.


15. Attendance

In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another Photographer to attend your wedding on our behalf to undertake the wedding photography to his/her best ability.  


16. Limitation of Liability

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. It is highly recommended that Client(s) have a full wedding insurance to cover unforeseen circumstances.


17. Force Majeure (Act of God)  

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.


18. Personal Accident

Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons’ own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.


19. Country of Jurisprudence

This agreement shall be governed in accordance with the laws of England and Wales
